Dear Fellow Investors
It has been a while since we communicated on this email ID. Many of you have probably moved on in life and might not be interested in the project any longer, but many might still be interested. I’m sure most of you would have received the recent communication from ‘Marina Exclusive Limited’ (MEL) designed to simultaneously frighten us and galvanize us into action.
The email purports to be from MEL, gives no steps for their proposed action and frightens investors by claiming that we will only receive 20-30% of our payments back. I have written to them asking the obvious question: Who are you? Talibi or Mondadori or Todisco’s heirs? Why should we trust any of them after they lied to us and cheated us out of our money for many years? How do you propose to revive the project and what is your financial proposal?
Of course it is every individual’s prerogative to decide if they wish to support them or not but I know they will not have my support. Firstly, I have just been through the cancellation and refund procedure on another infamous project, Eden Blue. It took approximately 3 years for the cancellation committee to collect all the data regarding the investors, verify this data, auction the plot and prepare the refund cheques. The total amount refunded was approximately 60%. Therefore, MEL have already started with their lies by suggesting that the refund will only be 20-30%. Secondly, how many projects have any of the people involved in KPM Tower completed and handed over? Zero, none, nul, nada. And they expect our support with that kind of track record!!!
I have been talking to some very well connected and experienced people who have revived 4 Towers and handed them over in the past. My proposed structure was somewhat similar but has been thought through to give investors a chance to get their units and deal with reputable individuals.
If we know we have your support, we will:
· Arrange for the plot to be transferred to an association where all investors will be joint owners.
· Ask the authorities to either demand the previous developers to compensate us for some of our losses or to cancel their units and allow the association of genuine investors to sell them and use the money towards construction costs.
· Negotiate with banks for Construction Finance secured on the plot value which we have already paid for. This can be converted into a post-handover installment plan with the bank if required.
· Negotiate with EMAAR regarding penalties.
· Prepare stage payments based on progress milestones. If an investor cannot afford to pay, we will try to sell their units and give them the maximum refund possible.
· Set up proper escrow accounts for transparency and safety of investors.
· Complete the project within 3 years of getting approval from the Court and the Land Department.
What will it cost?
1. 2% of the original price of your unit to set up the above procedure and secure the transfer of the project to investors. This will be payable only after we have approval letters from the Court and Land Department.
2. Architect’s charges, supervision and construction costs of AED 575 per square foot for the first floor units and increasing by AED 7 per square foot for each floor.
3. Retail units will pay according to a separate rate.
